As part of the UK Government’s broader manifesto plan to Make Work Pay, the Employment Rights Act 2025 introduced a power to use regulations and a code of practice to reinstate a strengthened ‘two tier code’ to address inequalities in pay and conditions between public sector and private sector staff working on outsourced public services following a TUPE transfer.

There is currently no date confirmed for this change. Keep an eye on our ERA 2025 Tracker for more information and updates.
