A disciplinary procedure is used where an employee is believed to have fallen short of the standards expected. A grievance procedure is used where an employee wishes to raise a formal concern about a workplace issue. Workplaces are legally obliged to ensure that these procedures are handled fairly and consistently. For this reason, employer’s procedures must support both the employer’s and employee's perspective.
This factsheet examines the essential facts around these procedures.
We provide a guide for CIPD members on how to conduct fair and rigorous processes in this area. Our guide for people managers advises managers on how to conduct these processes.
Members can also access information on the law on these matters, including how tribunal cases have tested challenges to discipline and grievance procedures.
